Depending on the host and league, you’ll play one of several formats. One requires an upfront payment to enter your league, but doesn’t charge you for players you pick up during the season from a free agent or “waiver” pool. The second format is free to join, but will cost you for most or all players you claim off waivers or as free agents after the initial draft period ends. Using your basic understanding of football, and drawing on your NFL savvy, or some free or paid information sources to review, you’ll rank real NFL players before your league draft. You may also be able to use the players as “pre-ranked” by your host.
You’ll also need to decide whether you want the excitement and time commitment of a live draft, or the relative ease and less time offered by an automated draft. If you are a beginner, the automated draft is highly recommended.
During the season, there are “BYE” weeks, during which an NFL team and its players get the week off to recharge. Real players also can be injured, so you lose their productivity. On the other hand, you and your team don’t get any time off, so you’ll probably have to make trades and perform waiver wire moves to ensure that you have a full, strong team playing every week.
Those are the basics. Now, it is up to you to apply your special knowledge, instinct or hunches, and “Win one for the Gipper”. Before your draft, you might want to challenge friends, family members or co-workers who have similar skills to yours to join your league. Some healthy competition can make your fantasy football experience even more enjoyable.
As with any game, keep in mind that it is only a game. You will not become rich or popular dependent upon how well you play. It is mostly purely entertainment. If you keep this in mind and don’t take yourself or the game too seriously, you will have a great time. Consumers who have experienced unfair business practices from eBay and Paypal, e.g., where the companies refuse to live up to their buyer protection programs, may have recourse in a court of law. Typically unsatisfied consumers have bought a product on eBay or pay for it using Paypal only to find that the article is not as represented, is a different color or size than pictured, or arrives in a broken and unusable condition. When the consumer complains to eBay and Paypal and asks for a refund, both of these eBay-owned companies disavow any responsibility owed to the consumer.
This article will present a guide for consumers to prosecute eBay and Paypal for deceptive business practices that harmed them and what they can expect from eBay and Paypal in terms of defenses. At the outset, note that eBay and Paypal have managed to insulate themselves from damages claims through creative wording of their user agreements, which all consumers must agree to accept as a condition for using either eBay or Paypal.
Paypal, Inc., is a subsidiary of eBay, Inc., and the two companies are intertwined for purchasers of goods sold on eBay.com to complete payments to sellers using Paypal.com. The Defendants Paypal, Inc. and eBay, Inc., may be served with process (summons and a complaint) using the long arm statute of the consumer’s state. The long arm statute most likely provides for service of out-of-state corporations through the state’s Secretary of State. eBay’s may be served with process at the following address: eBay Inc.; Attn: Corporate Counsel; 2145 Hamilton Avenue; San Jose, CA 95125.
Upon receiving the consumer’s lawsuit, the defendants eBay and Paypal will advise the consumer that his or her user agreements with these two firms require the consumer to file disputes against the firms either with a court in Santa Clara County, CA, or with the National Arbitration Forum. If the consumer does not voluntarily withdraw his suit, then eBay will threaten to seek its lawyer fees to have the case dismissed. At this point, most consumers then drop their suits.
However, the arbitration clauses in the user agreements exclude claims for equitable or declaratory relief. Accordingly, if the consumer files his suit from the outset seeking equitable or declaratory relief, then the eBay user agreement defense will NOT prevent the lawsuit from going forward. With the lawsuit proceeding forward, the consumer can send eBay or Paypal interrogatories to seek discovery. Interrogatories are written questions sent to a party to a lawsuit that must be answered in writing, usually within 30 days. With interrogatories, the consumer can get access to information about the seller, as well as the frequency with which consumers have complained about items being delivered that were materially different from the item pictures on eBay.
The consumer’s local state court will have personal jurisdiction over the eBay and Paypal to hear claims for equitable and declaratory relief, because these firms have established substantial contacts the consumer’s state. The following non-exhaustive list of activities and contacts by the eBay and Paypal in and with the consumer’s state make it fair, equitable, and convenient for eBay and Paypal to defend these causes of action in the consumer’s state:
(1) The controversy arose out of the consumer’s purchase of some item on eBay.com, which was shipped to him or her at the consumer’s address, and which arrived damaged and unusable. The funds used to pay for this transaction were drawn from a bank in the consumer’s hometown, and payment for this transaction occurred in the consumer’s hometown. The contract to purchase the item and pay for shipping was most likely formed in the consumer’s hometown.
(2) For more than 10 years, eBay and Paypal have systematically and continuously advertised their services to the consumer and other Internet users in the consumer’s state via advertising and electronic mail. Over the years, eBay and Paypal have collected fees on scores of millions of dollars in payments and seller fees from businesses and residents in the consumer’s state.
For circumstances in which a seller refuses to take back damaged merchandise and issue a refund, the consumer can seek equitable relief to bar that seller from any and all further transactions on the eBay and Paypal platforms. The consumer can seek declaratory relief that eBay and Paypal’s Buyer Protection Plan submission forms are riddled with computer errors and will not allow users to properly submit claims.
The consumer should also seek declaratory relief that eBay and Paypal’s fraud violated the state Consumer Protection Act, which thus gives the consumer a statutory right to prosecute eBay and Paypal independent of any breach of contract claim he or she may have related to the user agreement.
The consumer can also challenge in his local state court the validity of the arbitration clause as unconscionable. A claim that the arbitration provision is unconscionable is a matter to be decided by the courts and not the arbitrator, because it specifically challenges the validity of the agreement to arbitrate irrespective of the validity of the whole contract. If the state trial court determines that the arbitration clause is unconscionable, then the consumer will be entitled to pursue monetary damages against eBay and Paypal. However, it is unlikely that a state court will find the arbitration clauses unconscionable, due to the pro-business tilt of the U.S. court system.

Well, it’s that time of year that most of us either love or hate (or a little of both).
The holiday season is upon us and although you may be likely to pack on some pounds during this time of bountiful food, with a little planning, that doesn’t have to be the case.

1. Nibble on food throughout the day.
If you graze and snack on a little here and there all day, you will not build up that chance to be extremely hungry.
Instead of eating one large meal, which ends with an unbuttoning of the pants to let your extended stomach go free, try having 2 or 3 smaller meals throughout the day.
Not to mention, eating smaller snacks throughout the day keeps your metabolism burning faster.
Two or three hours before the “sit-down dinner, snack on some fruit, some carrot and celery sticks, or any other lower calorie foods. Then, when it’s dinner time, you won’t be as hungry.
2. Skip the gravy, dressings, and high-calorie condiments.
If you’re cautious about calories but still want to enjoy the main Thanksgiving feast, skip the gravy and fatty dressings.
If the turkey is too dry without some type of sauce, use ketchup or a low-fat gravy. Many times, the dressings and condiments are worse culprits than the foods you put them on.
3. Eat more vegetables with your meal.
Instead of loading up the potatoes and stuffing, choose to have more vegetables with your turkey.
On a calorie basis, you’re better off eating a larger serving of veggies than you are carbs like potatoes, rice, stuffing, or bread.
4. Drink a lot of water throughout the day.
This will help with hunger throughout the day. Water is a great appetite suppressant and if you’re constantly sipping all day, you will not find yourself starving.
5. Go outside and be active
Sitting around the house all day watching T.V., smelling the food cooking will keep you salivating and your stomach growling.
Take a pre-dinner walk with the family or the dog. Go to the park, watch the kids play ball. If you’re really motivated, go for a jog/run before dinner or later in the evening.
Being active will not only help burn off more calories than sitting in front of the tube, it will also keep you from being in “eating mode” from the kitchen aromas.
7. Have a smaller dessert
Don’t skip dessert, just moderate it. Have a small sliver of pie with a larger serving of Fat-Free Cool Whip or other non-dairy topping.
Again, my feeling is to enjoy yourself and eat a little of anything you want. The holidays are not a time to feel deprived. They are meant to be happy, spending time with friends and family.

It may be business or pleasure that has you travelling to Alicante, Spain, but whatever the reason is you are going, getting there is a breeze. Getting There
Alicante is best reached by air from countries around the world. The El Altet International Airport is located just 6 miles (10 km) from the heart of the city. There are daily flights from other major cities in Spain including Madrid, Ibiza and Barcelona. The Alicante airport is also serviced by major airline carriers from around Europe.
Travelling to Alicante is also possible by train or bus. Car hire services can be used within the city limits as well. Since Alicante is a region with its primary city bearing the same name, there are several other smaller towns that are accessible in Alicante by the railroad system known as the tram and trenet. These smaller railways go to Denia, Altea, and Benidorm. The two way services in and out of Alicante use motor buses to connect the city with the outlying towns and villages.
A ferry from Algeria can also bring you into the city limits of Alicante. It is booked by going throught Romeu to Oran or Algeria. This is not the best or most reliable method of getting there since there can be upsets in service due to the political atmosphere of Algeria at any given time.
Once inside the city limits, it is really a walking city because of its small size. However, taxis and intercity busses are available as well as the tram to an from Plaza del Mar to the airport outside of town.
Where to Stay
Those who travel to Alicante from far away will require overnight accommodations which can be found in abundance. Many high rise hotels in the city centre let you stay in the heart of the business district. There are views from these skyscrapers toward the mountains or sea.
If you prefer a more resort like atmosphere for your stay, just outside the city along the beaches are hotels with breathtaking seaside views and easy access to the sun and sand.
